UtahRealEstate.com (“URE”) takes matters of privacy and information seriously. URE operates an online multiple listing service and serves real estate professionals, their clients, and consumers looking for real estate. URE is committed to the protection and security of the information provided by visitors to utahrealestate.com (including the online and mobile versions) (hereinafter “Websites”). This Privacy Policy is set forth to help you understand the information collected by URE. Your use of the Websites constitutes your acceptance of this Privacy Policy, and all future revisions thereto.

Application of Policy

This policy applies to the Websites, subdomains of the Websites, and their associated pages (www.utahrealestate.com; www.join.utahrealestate.com; www.newmlsmember.com). This policy applies to consumers who use and subscribe to the Websites, real estate professionals and companies who use and subscribe to the Website, and any other visitor who uses or subscribes to the Website (collectively referred to herein as “you,” “your” “professional,” “user,” or “visitor.” Please note that there may be links to other companies and websites on the Websites that are not owned by URE, and URE is not responsible for the privacy policies or content associated with any linked websites. With respect to those companies and websites, this Privacy Policy is inapplicable and you should refer to the privacy policies of those companies and websites or otherwise contact those companies and websites directly.

In conjunction with this policy, you should also review our Terms of Use and, for visitors who subscribe to the Website, our End User License Agreement, for a more complete understanding of the rules and policies that govern your use of the Websites.

Types of Information Collected

When you visit the Websites, URE collects certain information about your visit, which URE stores indefinitely. Information collected from you will vary, depending on how you access, visit, or use the Websites, as well as what information you choose to provide to URE.

  • Personal Information

PROVIDING PERSONAL INFORMATION TO URE IS DONE VOLUNTARILY BY YOU. Personal information is individually identifiable information about you that URE may collect, use, and store on the Websites. For visitors to the website, this information may include, but is not limited to, your full name, a username and password, email address, and phone number. For the paying professional subscribers of the Website that use it for the multiple listing service, URE may collect your full name, a username and password, address, email address, personal website address, phone numbers, professional license numbers, professional designations, and REALTOR® or other membership affiliation. As a consumer, you may voluntarily choose to providethe above mentioned personal information to URE in the course of your use of the Websites, though no such information is required to use the Website. As a professional paying subscriber of the Website for use of the multiple listing service, you may be required to provide some of the above-mentioned personal information in order to properly utilize the Website and comply with the URE multiple listing service rules, terms of use, and other policies. Your use of the Websites and you voluntarily providing personal information to URE constitutes your permission for URE to use your personal information, unless you otherwise notify URE of your request to have your personal information removed from the Websites pursuant to the instructions provided in this policy. You can also choose not to provide URE with personal information, however, you may not be able to fully take advantage of the features of the Websites.

  • Children

The Websites are not intended for children under 16 years of age. We do not knowingly collect personally identifiable information from children under 16 without permission from a parent or guardian. If you are a parent or legal guardian and think your child under 16 has given us information, you may contact us at legal@utahrealestate.com.

  • Information Automatically Collected

URE may collect information about the type of internet browser you are using, the server name and Internet Protocol address through which you access the Websites, the pages you access within the Websites, information about your geographic location, how long you spend on the Websites, information you input into the Websites regarding your contact information or real estate listings, what downloads and/or search queries you have made, what emails you open or links you click, if you navigated to the URE Websites from another website, and the internet address of where you came from. URE may personally gather and use this information or obtain and use this information by way of collection of this information from third party companies. “Cookies” are also included information that may be automatically collected.

  • What is a Cookie?

A cookie is a piece of data that may be stored in the browser you use to access the Websites, which enables features and functionality. Cookies allow URE’s Websites to “remember” your activity or preferences over a length of time or during a particular session. If you're signed in to the Websites, cookies allow URE to show you targeted information and personalize your experience.

Some of the cookies URE uses have been developed and deployed to facilitate URE’s provision of the service. These are known as first-party cookies. URE also utilizes third-party cookies, which are built by URE’s third-party vendors and employed on our Websites and are explained further below.

  • How does URE use Cookies?

URE uses session cookies and persistent cookies. Session cookies are temporary cookies that are not stored in your browser beyond the session in question. They are used for authentication and security purposes and to ensure the effective and necessary functioning of the Websites features which you are utilizing. URE may also use a session cookie to remember your preferences when viewing the Websites. These session cookies are erased when you exit your browser.

Persistent cookies are those placed on your browser for a pre-determined length of time when you visit the Websites.

  • First-Party Cookies

URE develops and uses cookies via URE’s Websites to authenticate users and block malicious use of scripts. URE may use cookies to collect information on the Websites in order to understand and improve the Websites. These cookies also help URE learn how well our Websites operate across different locations and identify any issues in the operation and provision of our Websites.

  • Third-Party Cookies

URE also permits the setting of third-party cookies on URE’s Websites. These assist URE in measuring and understanding how URE Websites are used and how they can be optimized. URE may also receive other analytics information from these third parties.

Other cookies are used to assess performance and analytics, or to perform business research. URE uses the following cookies for performance, analytics, and research purposes: Google Analytics and Listtrac.

  • Advertising

Through URE’s advertising platform, Google Ads, URE delegates positions on the Websites to other third-party advertising agencies and networks who may serve advertising using cookies to the Websites.

  • Managing and Refusing the Use of Cookies

Most browsers allow you to choose whether you wish to accept cookies. Different browsers make different controls available to you and so URE provides links below to popular browser instructions on how you can do this. Generally, your browser will offer you the choice to accept, refuse or delete all cookies, or third-party cookies on a website, or those from specific websites. However, if you restrict URE’s capability to set cookies, you may limit the full functionality of the Websites, which will make some of our services and features unavailable to you.

  • ListTrac

URE contracts with a third party company called ListTrac. ListTrac collects information about your real estate viewing activities and preferences that allows ListTrac and approved 3rd party companies to engage with you through personalized, relevant adverts when you are browsing other websites and social media platforms, and through ListTrac’s analytics services. How Your Information May Be Used

When a user visits the Websites, URE may collect and process users’ personal and automatically collected information to: (a) improve the quality of the Websites and the services that URE provides to users; (b) to provide users with targeted advertisements; (c) to help connect users with professionals that subscribe to URE’s Websites; (d) to provide professionals who subscribe to URE’s Websites with tools, resources, features, and other information related to the subscribed services offered through the Websites; and (e) to provide professionals who subscribe to URE’s Websites with consumer leads, consumer and market exposure, and tools to communicate with consumers, other professionals, and URE.

URE may have to disclose, transfer, sell, or assign information obtained from you through the Websites to a third party if URE utilizes companies and individuals who URE employs or engages to perform services on URE’s behalf for the Websites or if requested by the government, law enforcement, or via subpoena. URE may also disclose information if URE is or may be acquired by another entity or engages in the sale of URE’s assets. Any release decisions may be made in URE’s sole discretion without your consent.

  • Emails
  • Consumers

Consumers and professionals may voluntarily provide email addresses to URE. Consumers’ email addresses are not made accessible to real estate professionals (unless the Consumer agrees to make their email addresses available) who subscribe to URE’s Website, however, professional subscribers do have the ability to manually add and systematically import email addresses of consumers into the Website if those professional subscribers are already in possession of those email addresses. Consumers are required to affirmatively opt-in before they can receive any automated email messages which are generated by URE on behalf of a professional that subscribes to the Website. Consumers who voluntarily provide email addresses to URE through the Website consent to receive email communications from URE, which includes, but is not limited to, promotional, educational, and other subject matters of email communications from URE.

  • Professionals

The email addresses and/or the means to contact professionals who subscribe to the Website are made available to other professionals who subscribe to the website in order to facilitate cooperation amongst said professionals in their use of the Website. Professionals who voluntarily provide email addresses to URE through the Website consent to receive email communications from URE, which includes, but is not limited to, informational, promotional, educational, and other subject matters of email communications from URE.

  • Advertising

URE utilizes advertisements in its Websites. URE wants to make these advertisements useful and relevant to you. As a result, URE may provide advertisements on the Websites based on information collected from you or in relation to your interaction with the Websites. The advertisers may utilize cookies and other technologies to your online activity and to learn what types of information are of most interest to you. Use of these technologies by the advertisers is subject to the advertisers’ own privacy policies.

Forums

The Websites may include discussion forums (such as message boards and chat features) that enable users of the Websites to communicate with one another. You acknowledge and agree that URE is under no obligation to moderate or edit the forums, and URE will not be responsible for the content or use of any material or information posted on any forum or chat feature included in the Websites. URE retains the right to delete at any time and for any reason whatsoever any material or information on the Websites.

How URE Protects Information

URE takes reasonable measures to ensure that any information collected is protected.  Please note, however, that due to the open nature of the internet, URE cannot guarantee that all communication between you and URE will be free from unauthorized access by third parties nor can we be responsible or liable for information harvested or scraped from the Websites by third parties. You can always refuse to provide personal information on the Websites, but doing so may result in decreased functionality of the Websites for you. If you suspect the personal information you provided to URE is being used in a way that is contrary to this policy, you are encouraged to contact URE via the method described herein so that URE may investigate your claim. 

Accessing, Changing, or Removing Personal Information

  • Consumers

Consumers who subscribe to the Website can access and change personal information provided to URE by signing in to the Website and accessing the Account Settings page. Consumers who wish to have their personal information removed from the Website must submit their request in writing to legal@utahrealestate.com.

  • Professionals

Professionals who subscribe to the Website can access and change personal information provided to URE by signing in to the Website and accessing the Account Settings page. Some personal information that a professional has provided to URE can only be modified by contacting URE, which can be done using the link below:

Your California Privacy Rights

While the Websites are intended to be used in the states of Utah, Idaho, Colorado, and Nevada, if you are a California resident that is using the Websites, you are permitted under the California Consumer Privacy Act to request certain information regarding any disclosure of personal information to third parties. URE reserves the right to change or amend this Privacy Policy at any time with or without notice to you. Your continued use of the Websites constitutes your acceptance of any revised Privacy Policy.
